The Act also extends the coverage period for structural defects from the current five-year term to seven years. In addition, driveways and walkways must be included in all new home warranties, items that were previously excluded from most warranties. The legislation was originally slated to come into force Jan. 1 of this year, but was delayed to give the province more time to implement a database for the registry. McInnes recommends buyers talk to their builder to learn more about their new home warranty and the protection it provides. "I think it will be a good thing," Crandell says. "I think what it will do is put all the builders on an even playing field. The warranty that they're going to be getting from the warranty providers will be the same with a few exceptions. It should get rid of some of the fly-by-night builders as long as the government has the ability to police things." The new legislation will require builders to register the warranty with a public registry before a construction permit is issued. It also places additional restrictions on builder- owners and bumps up the amount of coverage provided for new home repairs, from $50,000 to $100,000, and provides a warranty of up to one year on all repairs. Perhaps the best news for new home buyers is that the legislation provides an extended two-year period of coverage for the entire building envelope, including all mechanical, plumbing and electrical systems.
